Terms of Service – Digital Products

Welcome, and thank you for your interest in Mr. Tip Topper (“Creator,” “we,” or “us”) and our website at https://mrtiptopper-shop.fourthwall.com, hosted via Fourthwall (the “Service”). These Terms of Service (“Terms”) are a legally binding contract between you and Creator regarding your purchase and use of our digital products.

1. Acceptance of Terms

By accessing or using the Service, including by clicking “I Accept” or purchasing a digital product, you agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that:

  • You are at least 13 years old;

  • You have the legal right and capacity to enter into these Terms;

  • Your use of the Service complies with all applicable laws and regulations.

3. Digital Products Only

The Service offers digital goods such as SVG cut files, printables, and other downloadable content ("Digital Products"). Upon purchase, you are granted a limited license to download and use the product as outlined below.

4. License and Restrictions

Limited Use License

When you purchase a Digital Product, Mr. Tip Topper grants you a non-exclusive, non-transferable, non-sublicensable license to download, access, and use the file for personal use or as explicitly allowed in the product description.

You may not:

  • Resell, redistribute, or sublicense the digital file in original or modified form;

  • Claim the design as your own;

  • Upload the file to print-on-demand platforms (e.g., Redbubble, Zazzle, Printful) unless stated otherwise;

  • Share the file, in whole or in part, with others.

5. Account Information

You may be required to create an account to complete a purchase. You agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activity under your account.

6. Payment

All payments must be made in U.S. Dollars. By purchasing a Digital Product, you authorize Mr. Tip Topper (and our third-party payment processors) to charge your selected payment method for the full amount, including applicable taxes.

7. Delivery of Digital Products

After payment is successfully processed, you will receive a link to download your purchased files. If you experience any issues accessing your digital files, please contact us at mrtiptopper@gmail.com.

8. Refund Policy

Due to the nature of digital downloads, all sales are final.
Refunds, returns, or exchanges are not accepted unless the file is defective or corrupt, in which case a replacement file will be provided. If you believe a file is defective, contact us within 7 days of purchase.

9. Intellectual Property

All content, designs, and materials offered through the Service are the intellectual property of Mr. Tip Topper or its licensors and are protected by copyright and other applicable laws. Purchasing a file does not transfer any intellectual property rights to you.

10. Prohibited Conduct

By using the Service, you agree not to:

  • Use the files or Service for any unlawful purpose;

  • Violate any third-party intellectual property rights;

  • Interfere with the operation or security of the Service;

  • Attempt to reverse-engineer, hack, or disrupt the Service or digital products.

11. Modifications

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on the Service. Continued use of the Service after changes are posted constitutes your acceptance.

12. Termination

We may terminate or suspend your access to the Service at any time for violations of these Terms. Upon termination, your license to use any purchased digital products will also be revoked if obtained fraudulently or in violation of these Terms.

13. Disclaimer of Warranties

All digital products are provided "as is" without warranties of any kind. We do not guarantee that the files will be compatible with all software or devices. You are responsible for ensuring that the files are suitable for your intended use.

14. Limitation of Liability

To the maximum extent permitted by law, Mr. Tip Topper will not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service or any Digital Products.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in San Francisco County, California.
